Diamond B Technology Solutions, LLC (“DBTS”, “we”, and “us”) develops and provides software and technology solutions, such as, but not limited to, software having the ProCertX, LR-x and Track2Frac trademarks, that are offered and/or supported on certain websites (“Site”) where this privacy policy (“Privacy Policy”) appears. This Privacy Policy applies to the processing of personal information collected from a Site where this Privacy Policy appears.
By using the Site, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, and disclosure of your personal information as described herein.
The following key terms shall be used in this Privacy Policy:
- Aggregated Data: Data that is consolidated and presented in a summarized manner.
- Anonymous Information: Information that has undergone anonymization sufficient to no longer be used to identify an individual.

Joint Use
DBTS may use and jointly share Personal Data with our parent company, Diamond B Companies, Inc.
The scope of the joint use is explained below.
- Payment and accounting data needed to support our sales, marketing, and financial operations; and
- Human Resource data, such as employee data or prospective employee data.
How We Share Your Information
We will take reasonable steps to ensure any person or entity receiving Personal Data as described within this Privacy Policy is obligated to keep it secure. Our obligations do not apply to information shared with any government entity mandated under law or a lawful order to obtain such information.
External Processing
We use other companies, including our corporate affiliates, service providers, and other processors, to provide certain services to us, based on our instruction, and in compliance with appropriate confidentiality and security measures. These service providers provide services globally, including:
- providing payment or fraud protection services;
- hosting or maintaining a Site;
- performing security checks;
- providing optimization services;
- serving advertisements to a Site or third party websites;
- sending mail or email;
- providing employment and human resources related services; and/or
- providing customer service.
We will not share your Personal Data with our service providers unless required for the purposes of our legitimate interests or fulfilling our obligations to you.
With Our Suppliers
We will provide certain Personal Data, Anonymous Information or De-identified Data to our Suppliers to fulfil our obligations to you and as otherwise described in the “How We Use Your Information” section, including:

- fulfilling your order;
- allowing a Supplier to record your purchase;
- to enable your access to products or services provided by our Supplier or its suppliers;
- warranty, technical support, or after-sales service;
- customer service;
- allowing our Supplier or its service provider to provide services in connection with a Site (such as customer support or single sign-on functionality);
- for other similar purposes which are necessary for us to fulfil our obligations to you.
To Comply with Legal Requirements and Prevent Fraud and other Crime
Within applicable law, we may disclose Personal Data about you when we believe disclosure is appropriate to:
- comply with a legal requirement;
- prevent or investigate a possible crime (such as fraud or identity theft) or breaches (also suspected breaches) of security or of this Privacy Policy;
- protect the legal rights or safety of DBTS, our employees, Suppliers, third parties, the general public, or you.
In connection with a Sale, Merger or Related Event
Unless otherwise barred by local legislation, if a corporate affiliate or third party acquires our business, specific assets or the business of one of our operating divisions, your Personal Data will become owned by that company. In that event, the acquiring company’s use of your Personal Data will be subject to the governing Privacy Policy, any applicable supplemental privacy notices, and your expressed privacy preferences.
Aggregated or De-Identified Data
We may use or share information that has been aggregated or de-identified so that it cannot reasonably be used to identify an individual.
How We Protect Your Information
We will process your Personal Data on secure computer servers in the United States. A copy and/or back-up of your Personal Data may be stored and otherwise processed in accordance with a disaster recovery program.
We take reasonable steps to provide a level of security appropriate to the sensitivity of the information we collect. However, we cannot guarantee the security of information provided over the Internet or stored in our databases. You are also responsible for taking reasonable steps to protect your information, such as protecting your password and signing off when you finish using a shared computer or mobile device. If the Personal Data under our custody is (or is likely to be) divulged, damaged or lost, we will take reasonable remedial measures, inform you, if impacted, in a timely manner and report to government agencies if and as required by applicable laws.
Your Rights to Access and Control Your Personal Data
We respect your right to make choices about the ways we collect, use, and share your Personal Data. If you would like to review, correct, restrict the processing of, or object to direct marketingyou can contact us as outlined in the “How to Contact Us” section of this Privacy Policy. If there is any error in the Personal Data that you have submitted to us, you can correct it by logging into your account or contacting us as outlined in the “How to Contact Us” section of this Privacy Policy. We will take reasonable and appropriate measures to complete or attempt to complete corrections. However, we reserve the right to limit or deny your request if you have failed to provide enough information to verify your identity or to satisfy our legal and business requirements as noted in our data retention policy.
Data Retention Policy
We may retain your Personal Data and transactional data for as long as you continue to use the Site and thereafter, as permitted or required by applicable law or to satisfy our business requirements.
Children’s Privacy Policy
Our services are not directed at nor targeted towards children. If you have not reached the age of majority or are not able to enter into legally binding agreements in your country, you may not use the Site.

We periodically review and update this Privacy Policy. Any changes will become effective immediately upon posting.
